Bianca Jagger fees and back rent could hit $440K

Bianca Jagger could owe as much as $438,000 in fees and back rent as the result of losing her five-year battle to keep her rent-regulated apartment at 530 Park Avenue, attorneys representing the landlord said. A hearing in New York State Supreme Court is scheduled for Monday to begin the process to determine how much Jagger, the former wife of singer Mick Jagger, owes after losing her fight to retain the rent-stabilized unit in the building at Park Avenue between 60th and 61st streets in late 2008. The legal fees for landlord Katz Park Avenue are believed to amount to over $200,000 and what she owes in rent for the period she remained in the unit after her lease expired was estimated at $238,000, attorney Jeffrey Goldman, a partner at Belkin Burden Wenig & Goldman who is representing the landlord, said in an e-mail. The back rent was based on a monthly charge of $7,000. Jagger was evicted from the unit in December 2007, court records show.

If you plan to take out a mortgage or refinance anytime soon, you might want to hear this blunt message from federal officials: Don't fly blind. When you're shopping among competing lenders for the best loan terms and fees, make sure you know which quotes come with a guarantee, and which do not. Depending upon how loan officers provide their quotes upfront -- on an informal "worksheet" that carries no federal consumer protections, or on a new, three-page "good faith estimate," mortgage shopping tool that comes with rock-hard guarantees -- there could be a world of difference. A loan officer might quote you fees that are lowballed by hundreds of dollars on an informal worksheet to get your business in the door. But if the quotes are made on a GFE, they've got to be accurate because under new federal rules that took effect Jan. 1, any significant excesses must come out of the lender's own wallet at settlement. Last week, the Department of Housing and Urban Development brought together representatives of the highest-volume mortgage lenders in the country -- who originate a combined 80 percent-plus of all new home loans -- to review the agency's reformed GFE and closing documents.

NY-area bank sued for allegedly hiding risky real estate loan information

Smithtown Bancorp, one of the largest independent banks in the New York area with $2.7 billion in assets, is facing a class action suit by shareholders for allegedly hiding information about risky construction and real estate loans that eventually led to intervention by federal and state bank regulators. The bank was forced at the end of January to sign agreements, called consent orders, with the Federal Deposit Insurance Corp. and the New York State Banking Department, to reduce the amount of commercial loans and improve its loan underwriting policies or face further regulatory action, including potential seizure of its assets. The complaint, filed in U.S. District Court for the Eastern District of New York, alleges that the bank provided false and misleading information about the performance of its lending business and real estate assets, causing company stock to soar on the NASDAQ markets. The complaint referenced press releases and other statements where the bank claimed to be outperforming rival banks during the real estate boom and even after the capital markets collapsed in September 2008. “Defendants’ false and misleading statements had the intended effect and caused SBI common stock to trade at artificially high levels throughout the class period, trading as high as $24.50 per share on Sept. 29, 2008,” the plaintiffs alleged. By Feb. 2, 2010, the bank’s stock price fell as low as $4.16 a share.

Freddie Mac to end interest-only mortgage purchases

Freddie Mac is planning to end its purchases of interest-only mortgages by September, the mortgage giant announced today. That includes the company's own Initial Interest fixed-rate and adjustable-rate mortgages, which allow interest-only monthly payments for a certain period, after which monthly payments switch to principal plus interest for the remainder of the mortgage term. The government-backed company said it will also halt its practice of securitizing such mortgages. TRD

Foreclosure forces sales freeze at One Mad.

After being hit with a foreclosure suit this week, sales have halted at One Madison Park, according to Curbed. After defaulting on their mortgage, Ira Shapiro and Marc Jacobs, the developers of the 60-story tower, were served with the suit, which claims they owe their lender upwards of $200 million. Tamir Shemesh, the Prudential Douglas Elliman agent who has been marketing the listings at One Madison, said that the foreclosure proceedings have forced the sales hiatus. “The developer can’t engage buyers with contract of sales,” Shemesh said.

On days like this, he sometimes hires a four-wheel drive vehicle from a car service to ferry clients from one listing to another.

Real estate bigwigs settle in $50M kickback scheme

Two prominent New York City real estate bigwigs, investor Rubin Schron and attorney Leonard Grunstein, have settled charges with the U.S. Justice Department that alleged they had taken a $50 million kickback from Omnicare, the largest nursing home pharmacy in the company, according to Crain’s. The charges against Schron, Grunstein and their associate, Murray Forman, claimed that the three had organized a plan to receive the kickbacks in exchange for allowing Omnicare to continue providing to Mariner Health Care, a chain of nursing homes Schron owns. Grunstein, who was once involved in the landmark Tishman Speyer-Stuyvesant Town deregulation case, and the two other men paid $14 million in the settlement.
